H. Scott Johnson, Jr. is a co-founder of PCT Law Group and serves as its Managing Member.

Mr. Johnson is well-regarded for his employment and complex civil litigation practice. He routinely represents Fortune 500 clients in employer-employee disputes arising under Title VII, the Fair Labor Standards Act (FLSA), the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), and the Age Discrimination in Employment Act (ADEA) as well as issues pertaining to employment contracts and restrictive covenants (e.g., non-compete, non-solicitation, and confidentiality provisions). Mr. Johnson’s complex civil litigation experience includes representing businesses in a wide-variety of contract disputes and business torts including tortious interference, breach of fiduciary duty, civil conspiracy, defamation, fraud, and misappropriation of trade secrets.

In addition to his active litigation practice, Mr. Johnson serves as the “outside general counsel” for several small and mid-sized companies, where he counsels and advises businesses at all stages of the growth cycle on a broad range of matters, including corporate formation and organization, mergers and acquisitions, business contracts, employment agreements, employment policies, joint ventures, and corporate transactions.

Mr. Johnson received a Martindale-Hubbell Peer Review Rating of “AV Preeminent” (the highest rating level) in the practice areas of Litigation, Labor & Employment, and Business Law. Additionally, he has been recognized as one of the “Best Lawyers in America” in Employment Law (Management); a “Top Rated Lawyer” in Labor & Employment by American Lawyer Media; a “Top Rated Lawyer” in Labor & Employment by Martindale-Hubbell; and, named as a “Legal Elite” in Business Law by Virginia Business Magazine.

For several years, Mr. Johnson was a Professorial Lecturer in Law at the George Washington University Law School, where he taught transactional drafting to upper-level law students. He also served on the George Washington University Law School Alumni Board of Directors (2006-2009).

Mr. Johnson is also active in civic and community endeavors. In 2014, Mr. Johnson was appointed by Virginia Governor Terry McAuliffe to serve on Virginia’s Board for Professional and Occupational Regulation. Previously, Mr. Johnson was appointed by then Virginia Governor Tim Kaine to serve on Virginia’s Public Broadcasting Board from 2006-2010. Additionally, Mr. Johnson was appointed by Alexandria, Virginia’s City Council to serve on its Budget and Fiscal Affairs Advisory Committee from 2006-2008; and, he has also served on the Board of Directors for Alexandria’s United Way, the Carlyle House, and the Dunbar Alexandria-Olympic Branch of the Boys & Girls Clubs of Greater Washington. Mr. Johnson was a co-founder of Turning the Page, a 501(c)(3) organization that links Washington, D.C. public schools, families, and the community together in furtherance of providing students with educational resources and increasing public education.

Representative Litigation Experiences

  • Successfully represented a Fortune 100 company in a case involving Title VII, Americans with Disabilities Act (ADA), and § 1981 Civil Rights claims, resulting in the dismissal of the case.
  • Successfully represented a Fortune 100 company in a Family and Medical Leave Act (FMLA) and Age Discrimination in Employment Act (ADEA) case, resulting in the dismissal of the case on summary judgment. Currently representing the client on the appeal of the dismissal in the United States Court of Appeals for the Fourth Circuit.
  • Successfully represented a Fortune Global 500 company in an employment dispute, resulting in the dismissal of the case on summary judgment.
  • Successfully represented a Fortune 250 company in an employment action, resulting in the dismissal of the case on summary judgment.

  • Successfully represented a municipal bond insurance company in defense of a negligence action filed by a major financial institution, resulting in the dismissal of the case.
  • Successfully represented a foreign corporation in a trademark dispute before the Fourth Circuit Court of Appeals, resulting in a favorable appellate ruling and the dismissal of the case.
  • Successfully represented an architectural firm in an action against a former executive for breach of fiduciary duty and breach of restrictive covenants, resulting in a favorable jury verdict.
  • Successfully obtained dismissals of employment discrimination charges filed in jurisdictions throughout the United States.

Representative Business Transactions Experiences

  • Advised national government contractor on day-to-day employment matters including its employee handbook, non-disclosure agreements, confidentiality agreements, and separation agreements.
  • Drafted a Memorandum of Understanding memorializing the terms of a joint venture between three Fortune 100 companies for the creation of a task force to assist small technology businesses.
  • Counseled national commercial mortgage lenders on contractual issues relating to real estate acquisitions, secondary market transactions, and loan refinancing.
  • Represented a consulting company in the preparation of joint venture agreements, licensing agreements, and independent contractor agreements.
  • Represented a national government contractor in the preparation of various commercial agreements, non-disclosure agreements, professional services agreements, licensing agreements, and termination agreements.
  • Represented an American graphic design company in the acquisition of a Canadian business.
  • Represented clients in the negotiation and settlement of a variety of employment disputes arising under Title VII (discrimination), Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA), and Fair Labor Standards Act, as well as disputes relating to employment agreements and restrictive covenants.
